Dashcam video taken from his own truck helped lead to a felony charge and 4-month jail sentence for a 51-year-old Gig Harbor man after a road rage incident on State Route 12 in March.
The video, obtained by The Daily World, appears to show the defendant Robert Lewis Shaw intentionally ram the victim vehicle three times during the March 20 incident near the Monte-Brady Road exit.
The victim, John E. Gibson, 59, an attorney who lives in Seattle with a practice in Aberdeen, was westbound in the left lane around 7:30 a.m. with Shaw following. Shaw can be heard cursing angrily at the slow pace of traffic in the left lane on the foggy morning, and at one time refers to a police officer he spotted ahead with a racial slur.
“Don’t go slower, I’ll push your (expletive) car,” Shaw can be heard saying on the video moments before the crash.
Court documents state Gibson was concerned about Shaw’s 2003 Dodge Dakota pickup following so closely and Gibson elected to quickly tap his brakes before accelerating, at which point the video shows Shaw’s truck accelerate and strike the back of Gibson’s 2015 Subaru Crosstrek.
“Hey man, you want to hit your brakes in the fast lane?” Shaw can be heard saying on the video, moments before accelerating and again striking the rear of Gibson’s vehicle.
The video shows Gibson pulling onto the left hand shoulder, where he called 911. Shaw’s vehicle pulls onto the left shoulder ahead of Gibson’s car. Shaw’s truck can be heard accelerating in reverse, striking Gibson’s now parked car.
“Oops,” Shaw said.
Prosecutor Jason Walker asked Superior Court Judge Stephen E. Brown Monday to sentence Shaw to the top of the range, 9 months, for the felony charge of second-degree assault; Shaw was also found guilty of first-degree malicious mischief. Shaw’s public defender David Arcuri asked for the minimum, 3 months. Brown sentenced Shaw, who has no prior criminal record, to 4 months, which Shaw began serving immediately after sentencing.
